Indonesia has popular concept of democracy with direct elections. For the third time, the people of Indonesia to elect a head of state directly. Head of government from the city level up to the governor also elected directly by the people. This is believed to be an effective way to filter the wise leader and preferences of the people. The enlargement of democracy also bring the Local leaders to have greater autonomy in controlling its own territory.
Local leaders can be more creative and innovate, more independently in several ways in order to develop the region. The extent of this authority provides an opportunity for each region to be fully developed according to the potential of their respective regions. Many local leaders who successfully bring a positive change in the region they lead. Starting from Surakarta, Joko Widodo, the Region of Pekalongan Bashir Ahmad, the Bandung leader Ridwan Kamil, Bima Arya of Bogor, Surabaya Tri Rismaharini, Kudus Musthofa and much more.
However, that does not mean all regional head by direct election results reflect the positive side. There are also local leaders were actually involved various legal cases, especially corruption, and some are not working optimally. However, the election law that is applicable, Act No. 32 of 2004 are considered not quite able to overcome this problem. It is a dilemma, given the often also reported the presence of heads of regions that have poor performance, not disciplined and well behaved. The mechanism of sanctions for poorly performing regional heads are not included in Law No. 32/2004 on Regional Government. The bill is ready for approval at the next plenary session of the Parliament on Tuesday September, 30th 2014.
This RUU contains a balanced way about the existence of reward and punishment to the head area. Unlike the previous law which only focuses on the reward rather than punishment alone.
